1- Company: All Trek Top Expeditions: (A.T& Jungle SAC) is a official Travel Agency in Peru Is register with the State of Peru. Registration No.365-GR-DIRCETUR CUSCO Municipal licenced 005997

2- Tour Operator / Travel Agency Responsibilities: All Trek and Tours, is an independent contractor that arranges packages for individual and group travel. Responsible for making the arrangements for all Treks and accommodations & services, except to the extent that accommodations or services cannot be supplied due to reasons beyond their control.

3- Responsibilities and obligations.
is responsible for providing all the services and accommodations exactly as advertised on the web site. Even if the chosen hotel would had an unforseen problem we can accomodate you in a similar or better to the offered previously.

4- Prices and Surcharges.
The published prices are exacts and do not conceal additional unpublished payment in the inclussions of each program. Of being the prices because of govermental measures subject to a considerable increasing the company is obligated to inform our client on this change. If this increase brings as result an unfair cost the client has the right of cancelling and demand the refund of his advanced payment in a three days term of having been informed.

5- Acceptance of risk.
The programs had been designed in a very safely manner in order to provide the participants with an reasonable exposure to the raw nature of the visited environment and therefore involve an element of personal risk and exposure to potential hazards which are associated to the normal "package" holidays. The client acknowledges that the main feature of the tour is adventurous and that such activity may involve a significant amount of personal risk.

6- Authority on Tour.
At all times the decision of the company's guide or representative will be final on all matters likely to endanger the safety and well being of the tour group. The client must at all times strictly comply with the laws, customs, foreign exchange and drug regulations of Peru. Should the client fail to comply with the above, or should the client interfere with the well being of the group then the guide or company representative may order the client to leave the tour without recourse to any refund.

7- Travel Document.
The client must be in possession of a valid passport and all visas required for the whole of the journey and the client accepts responsibility for obtaining the same. Any information or advice given by the company on visas, vaccinations, climate, clothing, baggage, special equipment, etc is given in good faith but without responsibility on the part of the company.

8- Factors Outside the Company's Control (Force Majeure)
The company will do its best to minimize the effects of matters outside its control, but cannot accept any liability for these matters which include political disputes, border closures, refusals of visas, industrial action, delayed flights, unforeseeable climate, etc.

9- Insurance.
It is the client's responsibility for obtaining sufficient personal travel insurance. The client is willing to accept full responsibility for insurance up to limits that the client may require. This insurance must cover personal accident, medical expenses, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury delay or inconvenience occurring to the client. It is compulsory that all clients have personal travel insurance. When obtaining travel insurance the client must ensure that the insurer is aware of the type of travel to be undertaken.

10- Increments applicable for Inca Trail and alternative treks:
We are committed to leaving on any trek with you regardless of number of people in the group (we definitely WILL NOT pass you onto another agency). For this reason, if there are 2 and 3 peoples only in your Inca Trail group, we kindly request you pay an increment as follows:
2 or 3 peoples USD$40

IMPORTANT: By paying this extra charge your trek effectively becomes a private service (cheaper than the actual private service!) which allows you to pace yourself, see and explore more as you aren’t in a big group! Also the increment will help us to fully comply with all that is included in your tour and fulfill our obligations to our staff (guides, chefs, porters, etc).
***$35 per person is also applicable to all groups regardless the size to leave during these holidays: Christmas (Dec 22nd, 23rd, 24th, 25th, New Year Dec 29th, 30th, 31st, Jan 1st)
An increment is also applicable in order to leave during election days (people are fined here if they don't vote). In this case, we use the increment to pay staff a bonus for leaving on their holiday or is used to pay the fines.

11- CANCELLATION POLICY
1.Our company can cancel a tour only on the next situations: majeure causes like natural disasters and others that turn impossible the enjoyment of the chosen program tour.
2.Because missing the advanced payment or the remainder (balance).
3.If the client before starting his tour is under the influence of alcohol or any illegal substance or maybe in an obvious bad state of health will be deprived from his tour without the right of refunding or switching the departure date nor the kind of service.

12- Responsability.
Our Company shall not be liable for any damage or loss if the failure to carry out the contract is: 1) attributable to the client 2) attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable 3) due to unforeseen and unusual circumstances beyond the company's control, the consequences of which could not have been avoided even if all due care had to be exercised. 4) due to political disputes, industrial action, climate or other matters of a similar nature and any other force majeure. 5) due to an event which the company, even with all due care could not foresee or forestall. Any liability is limited to the full price paid for the tour. In all cases the company specifically excludes all liability for indirect or consequential loss or expense including loss of profits.

13- Claims and Complaints.
If a client has a complaint against the company the client must first inform the tour guide or company representative while on the tour in order that the guide/representative can attempt to rectify the matter. Any further complaint must be put in writing to the company within 2 days of the end of the tour.

Applicable Law: This agreement is executed in and intended to be performed in the state of Peru. The laws of Peru State shall govern its interpretation and effect. I have fully read, understand and agree to the terms and conditions including cancellation policies & conditions.
Entire Agreement: This contract contains the entire agreement between all parties involved and it completely supersedes any prior written or oral agreements or representations. This contract can be amended only in writing, signed by both parties of this agreement. Any oral representations or modifications shall be of no force or effect.
